Copyright and takedowns
Effective [date]. We respect creators' rights. That is the whole point of CopyRise. This policy follows the Digital Millennium Copyright Act (17 U.S.C. 512).
Designated agent: Trisha Rutten, Rebel Shed LLC (CopyRise), 414 N Broadway, Pelican Rapids, MN 56572. Phone: 701-540-1167. Email: trisharutten@gmail.com. U.S. Copyright Office Designation No. DMCA-1084165.
What CopyRise hosts
CopyRise fingerprints files in each person's browser. Rebel Shed doesn't receive users' files, except a deposit copy an artist uploads privately for the copyright filing service. On copyrise.ai, CopyRise hosts:
- Proof lookups: fingerprints and timestamp proofs anyone can look up. They don't contain the work itself.
- Buyer assistant pages: the assistant on an artist's license page, which answers from the artist's work titles and price list.
- The CopyRise website and its pages.
Artists host their own license pages and catalog sites, usually on their own Netlify account or website. If the page you're concerned about is at another web address, send your notice to that host. You can find a site's host with a WHOIS lookup.
Report material that infringes your copyright
Email or mail a written notice to our designated agent, with "DMCA notice" in the subject line. Your notice must include:
- Your physical or electronic signature. A typed full name is fine.
- The copyrighted work you believe is being infringed. If there are several, a representative list is fine.
- The material you want removed, and enough information for us to find it: the web address, and for a proof lookup, the fingerprint or record ID.
- Your name, mailing address, phone number, and email.
- A statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
If a notice is missing something, we'll tell you what to add. We may not be able to act on a notice that doesn't include these parts.
What happens after we get a notice
We review notices promptly, usually within two business days. When a notice is complete, we remove or disable access to the material quickly, and we tell the person who posted it. We send them a copy of the notice, which includes your name and contact details, so they can respond.
If your material was taken down: counter-notice
If you believe your material was removed by mistake or misidentified, send a counter-notice to our designated agent with "DMCA counter-notice" in the subject line. It must include:
- Your physical or electronic signature. A typed full name is fine.
- The material that was removed, and where it appeared before it was removed.
- A statement under penalty of perjury that you believe in good faith the material was removed or disabled by mistake or misidentification.
- Your name, mailing address, and phone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district where Rebel Shed may be found, such as the District of Minnesota), and that you'll accept service of process from the person who sent the original notice, or their agent.
When we get a complete counter-notice, we promptly send a copy to the person who sent the original notice and tell them we'll put the material back in 10 business days. We restore it no sooner than 10 and no later than 14 business days after we receive the counter-notice, unless our designated agent first hears from them that they've filed a court action to stop the activity.
False claims
Under 17 U.S.C. 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages, including costs and attorney's fees. Consider whether a use might be fair use before you send a notice. If you're not sure, talk to a lawyer.
Repeat infringers
We keep a record of each notice we act on, by account email. An account that has three upheld notices within 12 months is a repeat infringer. Notices that were successfully countered or withdrawn don't count. We may act after fewer notices when the infringement is clear and deliberate. A repeat infringer's account is closed: its buyer pages are turned off, it can't stamp new works or publish new pages, and any paid plan ends. These terms are part of our Terms.
Proofs recorded in Bitcoin
When a fingerprint is stamped, it's written into the Bitcoin blockchain. No one, including Rebel Shed, can delete it from Bitcoin. A fingerprint reveals nothing about the work, and a timestamp proves only that a file existed on a date, not who made it. When we act on a notice about a proof, we remove it from CopyRise's lookups and mark the record in our database.
If someone used CopyRise with your work
If someone stamped or licensed your work through CopyRise, tell our designated agent. Keep your own originals and records: earlier dated evidence of your authorship is your strongest answer, and you can stamp your own files with CopyRise for free.
Trademark and other complaints
The DMCA covers copyright only. For a trademark complaint (someone else's name or logo) or any other concern about content on copyrise.ai, email the address above with "Trademark complaint" or "Content concern" in the subject line. Tell us what the content is, where it is, and why it's a problem.
